2. PURPOSE AND SCOPE

These Terms and Conditions define the terms under which Les Écrins provides bed and breakfast accommodation, as well as any additional services that may be booked by guests.

They apply to bookings made directly with the Establishment, including through its website, by telephone or by email.

For bookings made through third-party platforms, such as Booking.com, the specific booking and cancellation conditions displayed on the relevant platform also apply. In the event of a discrepancy, the applicable conditions must be assessed in light of the commitments made by the parties and the relevant legal requirements.

By making a booking, the guest acknowledges having read and accepted these Terms and Conditions, subject to applicable law.

3. BOOKING AND CONFIRMATION OF THE STAY

A booking is recorded as soon as it is made and is confirmed with details including the dates of the stay, the room booked, the number of guests and the agreed price.

A deposit equivalent to 30% of the total cost of the stay is required to secure the booking.

If the deposit is not paid within the deadline specified at the time of booking, the booking will no longer be guaranteed. The Establishment reserves the right to release the dates concerned after informing the guest.

The remaining balance and any additional charges are payable in accordance with these Terms and Conditions and the specific terms communicated to the guest.

Any request to amend a booking is subject to the Establishment’s prior approval and availability. Changes may result in a price adjustment and, where applicable, the application of the cancellation conditions set out below.

4. PRICES AND INCLUDED SERVICES

Prices are quoted in euros and include all applicable taxes and service charges (including VAT, where applicable), except for taxes or services expressly stated as payable separately.

The price of the stay includes accommodation in the booked room and breakfast.

Additional services, including any late-arrival fees or special services booked before the stay, may be charged separately where agreed with the guest.

The applicable prices are those communicated at the time of booking. The confirmed price may not be changed unilaterally for the stay concerned, except where a change is requested by the guest or required by applicable law.

Tourist Tax

For bookings made directly through the Establishment’s official website, the tourist tax is included in the total price displayed and confirmed to the guest.

For bookings made through a third-party platform, particularly Booking.com, the tourist tax is not included in the price of the stay when it is stated as payable on arrival. In such cases, it is payable separately by the guest at the applicable statutory rate and in accordance with the arrangements communicated at the time of booking.

The tourist tax is collected and remitted in accordance with the applicable regulations. Any legally applicable exemptions are taken into account.

5. PAYMENT TERMS

A deposit of 30% of the total cost of the stay is required to secure the booking.

The remaining balance must be paid no later than the day of departure, unless otherwise agreed under specific booking conditions.

The following payment methods are accepted:

  • Credit or debit card;
  • Bank transfer;
  • Bank cheque;
  • Cash, subject to applicable legal limits.

Any fees associated with a payment method may only be charged where permitted by law.

If the guest experiences any difficulty making payment, they are invited to contact the Establishment as soon as possible to discuss a possible solution.

6. DURATION OF THE STAY

The booking is made for a fixed period corresponding to the confirmed dates.

The guest is not entitled to remain on the premises beyond the departure date specified in the booking.

Any extension of the stay is subject to the Establishment’s prior approval and room availability. Additional charges may apply.

7. ARRIVAL AND DEPARTURE

Arrival

Check-in is available between 4:30 pm and 7:30 pm.

Any arrival outside these hours must be requested in advance by telephone or email and is subject to the Establishment’s availability.

Late arrivals after 11:00 pm may be accepted subject to a €20 surcharge and the Establishment’s prior approval.

The Establishment reserves the right to refuse a late-arrival request if it is unable to accommodate the guest appropriately. In the event of an unexpected delay, guests are asked to contact the Establishment as soon as possible.

Departure

Rooms must be vacated by 11:00 am on the day of departure.

Late check-out requires the Establishment’s prior approval and may incur an additional charge if the applicable fee has been communicated to and accepted by the guest.

8. CANCELLATION BY THE GUEST

Any cancellation must be notified in writing, by email or post, so that the Establishment has a record of the request.

Unless different specific conditions have been expressly agreed at the time of booking or apply through a third-party platform, the following cancellation policy applies to direct bookings:

  • More than 21 days before the arrival date: the deposit paid will be refunded in full.
  • Between 21 and 4 days before the arrival date: the 30% deposit will be retained by the Establishment.
  • From 3 days before the arrival date, including the arrival date itself: the full cost of the stay is payable.

For the avoidance of doubt, the cancellation period is calculated by reference to the confirmed arrival date.

Where a refund is due, it will be issued using the original payment method, unless otherwise agreed or where this is not reasonably possible.

No-Show

If the guest fails to arrive on the scheduled arrival date without having cancelled the booking in advance, the full cost of the stay remains payable and no refund will be issued, subject to any mandatory legal provisions and the specific booking conditions.

Early Departure

Once a stay has commenced, the full cost of the stay remains payable. If the guest chooses to leave early, no refund will be issued for unused nights, subject to any mandatory legal provisions.

9. CANCELLATION BY THE ESTABLISHMENT

If the Establishment is obliged to cancel a stay before it begins, the guest will be informed as soon as possible by email or telephone, with written confirmation.

All amounts paid for the cancelled services will be refunded in full and without charge.

If the cancellation results from exceptional circumstances or an event of force majeure, the financial consequences will be determined in accordance with applicable law.

Nothing in this clause limits any rights the guest may have under applicable law.

10. USE OF THE PREMISES AND HOUSE RULES

Guests undertake to use their room, the furniture, equipment and facilities made available to them responsibly and in accordance with their intended purpose.

Guests must respect the premises, other guests, the neighbourhood and all safety instructions provided by the Establishment.

Noise likely to disturb other guests or neighbours is prohibited, particularly at night and when using the terrace and garden.

Parties, receptions and unauthorised noisy gatherings are prohibited.

The number of guests staying at the Establishment must not exceed the maximum occupancy permitted for the booked room or the number specified in the booking confirmation.

Visitors who are not registered guests may not stay in the rooms without the Establishment’s prior approval.

Smoking

Les Écrins is a non-smoking establishment indoors.

Designated smoking areas are available outdoors. Guests must use the ashtrays provided and comply with all safety instructions.

If the indoor smoking ban is breached, additional cleaning or restoration costs may be charged to the responsible guest, provided that such costs are necessary, reasonable and justified.

Any additional loss directly resulting from the breach may be subject to a claim for compensation, supported by appropriate evidence.

Damage and Loss

Guests are responsible for damage, loss or deterioration caused by themselves or by persons for whom they are responsible, where liability arises.

Repair, replacement or exceptional cleaning costs may be charged on the basis of actual, reasonable and justified expenses.

The Establishment reserves the right to seek compensation for any loss actually incurred, in accordance with applicable law.

Theft and Personal Belongings

Guests remain responsible for looking after their personal belongings.

The Establishment cannot be held liable for theft, loss or damage to personal belongings except where its liability may arise under applicable law.

11. MAXIMUM OCCUPANCY

Les Écrins has a maximum capacity of 10 guests, distributed as follows:

  • Améthyste Room: maximum 2 guests;
  • Célestine Room: maximum 2 guests;
  • Aventurine Room: maximum 2 guests;
  • Tourmaline Family Suite: maximum 4 guests.

The number of occupants must correspond to the number stated at the time of booking.

If the authorised occupancy limit is exceeded, the Establishment may refuse access to additional guests for safety reasons and to comply with occupancy limits.

Any change to the booking must be requested in advance and approved by the Establishment.

If these conditions are not respected, the consequences for the booking will be assessed in light of the circumstances, the applicable contractual terms and the relevant legal provisions.

12. PET POLICY

Pets are not permitted at the Establishment.

If this rule is breached, the Establishment reserves the right to terminate the stay without refunding any amounts paid.

13. ADDITIONAL SERVICES AND RELAXATION FACILITIES

Access to the outdoor jacuzzi is included in the price of the stay but requires advance booking of a time slot and is subject to availability.

Guests undertake to comply with the operating instructions and safety rules communicated by the Establishment.

The Establishment reserves the right to suspend or refuse access to the jacuzzi if safety instructions are not followed or if the conditions of use pose a risk to people or property.

14. INSURANCE AND GUEST LIABILITY

Guests are responsible for damage caused by themselves or by persons for whom they are responsible, in accordance with applicable law.

Guests are advised to check whether their home insurance or travel insurance covers damage that may occur during their stay, including under a holiday accommodation liability policy where appropriate.

This recommendation does not constitute a general obligation to take out specific insurance, unless required by applicable law or contractual provisions.

15. FORCE MAJEURE

Neither party may be held liable for a failure to fulfil its obligations where that failure results from an event meeting the legal criteria for force majeure.

The affected party must inform the other party as soon as possible and take reasonable steps to limit the consequences of the event.

The consequences for the stay, amounts paid and any refunds will be determined in accordance with applicable law and the circumstances of the event.

16. RIGHT OF WITHDRAWAL

In accordance with Article L. 221-28 of the French Consumer Code, bookings for bed and breakfast accommodation relating to specific dates are not subject to the 14-day right of withdrawal.

Any cancellation remains subject to the cancellation policy set out in Section 8 of these Terms and Conditions.

17. COMPLAINTS

Any complaint concerning a stay or service should first be addressed to the Establishment by email or post, using the contact details provided in Section 1.

The Establishment undertakes to review the complaint and respond within a reasonable period.

Guests are invited to provide any information necessary to assess their complaint, including the booking reference and relevant supporting documents.

18. CONSUMER DISPUTE RESOLUTION

In accordance with Articles L. 612-1 et seq. of the French Consumer Code, consumers may refer a dispute to a consumer mediator free of charge in order to seek an amicable resolution, after first submitting a written complaint to the Establishment and subject to the applicable admissibility requirements.

Consumer mediation service designated by the Establishment:

  • Telephone: 01 89 47 00 14
  • Website: https://www.cm2c.net/
  • Email: cm2c@cm2c.net

19. PERSONAL DATA

Personal data collected in connection with a booking is processed for the purposes of managing reservations, welcoming guests, providing the agreed services and complying with the Establishment’s legal obligations.

Details concerning the collection, use and retention of personal data, as well as the exercise of data protection rights, are set out in the Privacy Policy available on the Establishment’s website.

For any questions concerning personal data, guests may contact the Establishment using the contact details provided in Section 1.

20. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms and Conditions are governed by French law.

In the event of a dispute, the parties are encouraged to seek an amicable solution and, where appropriate, to use the consumer mediation service described above.

If an amicable resolution cannot be reached, the dispute may be brought before the competent courts in accordance with the applicable legal rules. Nothing in these Terms and Conditions shall deprive consumers of any rights afforded to them by law.

21. ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE

The guest acknowledges having read and accepted these Terms and Conditions before the final confirmation of the booking, subject to applicable law.

The specific conditions communicated to the guest at the time of booking, together with any applicable terms imposed by a third-party booking platform, supplement these Terms and Conditions to the extent permitted by law.
